These terms explain how BITis operates, what users can expect from the platform, and the rules that apply when buying, selling, or interacting with services on bitis.africa and the BITis app.
Introduction
These Terms and Conditions govern your access to and use of the BITis platform, including the BITis mobile app, the website at bitis.africa, and related services. By creating an account, browsing listings, purchasing products, selling products, or otherwise using BITis, you agree to be bound by these Terms.
Eligibility
You may use BITis only if you are legally capable of entering into a binding agreement, provide accurate information, and comply with applicable law. If you use BITis for a business, you confirm that you have authority to bind that business to these Terms.
Nature of the platform
BITis may operate as a marketplace for third-party sellers, a facilitator of ordering, communication, payment processing, and logistics coordination, and in some cases a direct seller where clearly stated. Unless BITis is identified as the seller, the seller remains responsible for the product listing, pricing, stock, legality, fulfilment, warranties, and after-sale obligations.
Accounts and security
You may be required to create an account to use certain features. You agree to provide accurate information, keep your details updated, protect your login credentials, and notify BITis promptly if you suspect unauthorized access or misuse.
Listings, product information, and availability
Listings may include descriptions, images, prices, delivery information, specifications, promotions, and seller information. While BITis may review or moderate listings, we do not guarantee that all listing content is complete, accurate, current, or error-free. Images may be illustrative, colours may vary by device, stock may change before an order is accepted, and pricing or listing errors may occur.
Orders and contract formation
Placing an order constitutes an offer by you to purchase the selected product or service subject to these Terms, the listing, and any applicable seller policy. An order is not necessarily accepted merely because you received an order confirmation, payment acknowledgment, or order number. BITis or the seller may decline or cancel an order before acceptance for legitimate reasons including product unavailability, listing errors, failed verification, suspected fraud, delivery limitations, or breach of these Terms.
Prices, fees, and charges
Prices are shown in the currency indicated at checkout unless otherwise stated and may change before order acceptance. Depending on the transaction, the amount payable may include the product price, delivery charges, service or handling fees, and applicable taxes or regulatory charges shown at checkout.
Payments
Payments may be processed through approved third-party payment providers. By submitting payment details, you authorize the provider, seller, and or BITis to process the payment for the transaction amount and any lawful adjustments, refunds, or reversals. Available payment methods may vary by product, seller, location, or risk screening outcome.
Delivery, collection, and risk
Delivery options may include seller delivery, courier delivery, BITis-arranged logistics, pickup, or other methods described on the platform. Delivery times are estimates unless expressly guaranteed. You must provide accurate delivery details and ensure someone authorized is available to receive the order where required. Additional charges may apply for failed deliveries, redelivery requests, remote areas, or post-dispatch changes.
Cancellations, returns, refunds, and replacements
Your rights relating to cancellations, returns, refunds, exchanges, and replacements are subject to applicable law, the nature and condition of the product, whether BITis or a third-party seller is the seller, and the relevant Returns and Refund Policy. Certain products may be non-returnable or subject to restricted conditions. BITis may request evidence such as photos, videos, serial numbers, packaging checks, or written explanations before approving a return, replacement, or refund.
Promotions and credits
Promotions, discount codes, coupons, vouchers, referral credits, wallet balances, and campaign offers are subject to their own terms. Unless expressly stated otherwise, they are non-transferable, may not be redeemable for cash, may be limited to specific users or products, and may be cancelled where obtained through abuse, fraud, or error.
User conduct
You must not use BITis for unlawful, fraudulent, misleading, or abusive purposes; interfere with platform security or integrity; manipulate reviews, prices, or orders; list prohibited or restricted items; or infringe the rights of others.
Prohibited products and activities
BITis may prohibit or restrict products, services, listings, or activities as required by law, regulation, payment provider rules, logistics constraints, or risk policies. We may remove listings, suspend accounts, hold funds, cancel orders, or cooperate with lawful requests where prohibited activity is suspected.
Reviews, ratings, and user content
Users may submit reviews, ratings, comments, images, messages, or other content. By submitting content, you confirm that you own it or have the right to submit it, that it is accurate to the best of your knowledge, and that it is not unlawful, abusive, or misleading. BITis may moderate, remove, reject, or disable content at its discretion.
Communications
By using BITis, you agree that BITis may send you service-related communications by in-app message, SMS, email, phone call, WhatsApp, push notification, or another contact method you provide, where lawful. These may include account alerts, order updates, delivery notices, security verification, dispute handling, and support communications.
Intellectual property
The BITis platform, including its software, branding, design, logos, text, graphics, and other original content created by or for BITis, is owned by or licensed to BITis and protected by intellectual property law. Except as expressly permitted, you may not copy, reproduce, modify, distribute, or exploit any part of the platform without prior written consent.
Third-party services
BITis may integrate with or link to third-party services such as payment processors, logistics providers, verification services, analytics tools, maps, messaging tools, and external websites. BITis is not responsible for the content, availability, policies, or practices of third-party services.
Suspension, disclaimers, and liability
BITis may suspend, limit, or terminate access, remove listings, delay payouts, cancel transactions, or impose conditions on your use where we reasonably believe you have breached these Terms or a policy, pose legal or operational risk, or are linked to fraud, prohibited activity, or repeated disputes. To the maximum extent permitted by law, the platform and services are provided on an as is and as available basis, and BITis will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the platform, third-party seller conduct, delivery failures, payment interruptions, listing inaccuracies, or good-faith enforcement actions.
Privacy, disputes, and changes
Your personal information will be collected, used, stored, and disclosed in accordance with the BITis Privacy Policy. If you have a complaint, you should first contact BITis so we have an opportunity to resolve the issue internally. BITis may amend these Terms from time to time by posting updated Terms with a revised effective date, and continued use after the updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.
Governing law and contact
These Terms are intended to operate under applicable Zambian law, subject to any mandatory consumer rights that cannot lawfully be excluded.
